FIFTEEN YEAR WARRANTY FOR NEW
CLEARSPANTM FRAME COVER PRODUCTS
A. GENERAL PROVISIONS: The warranties described below are provided by Engineering Services and Products Company (“Engineering Services”) to the original purchasers of new ClearSpanTM frame covers manufactured by Engineering Services against product manufacturing defects. ClearSpanTM frame covers are warranted on a straight line fifteen (15) year amortization basis. For example, if due to a product manufacture defect a ClearSpanTM frame cover requires replacement after five years, Engineering Services will pay 2/3 of the replacement cost.
B. WHAT IS WARRANTED: Subject to the limitations set forth in Section C below, defects in the manufacture of ClearSpanTM frame cover product discovered and reported within fifteen (15) years of the date of purchase.
C. WHAT IS NOT WARRANTED: Engineering Services is not responsible for the following:
(1) Used products; (2) Any product that has been used, altered or modified in any way not approved by Engineering Services; (3) Depreciation; (4) Damage caused by lack of reasonable and proper maintenance, failure to follow instructions, improper installation, misuse, lack of proper protection during installation, use or storage; (5) Damage resulting from accident; 6) Damage due to normal maintenance or lack thereof; (7) Exposure to harmful chemicals or other substances, foreign or natural; (8) Acts of God; or (9) Unforeseen causes or circumstances.
D. SECURING WARRANTY SERVICE: To secure warranty service, the purchaser must
(1) Report the frame cover product defect in writing to Engineering Services within the
warranty term; (2) Present satisfactory evidence of the warranty start date, and (3) Make the
frame cover product available to Engineering Services within a reasonable period of time.
E. LIMITATION OF IMPLIED WARRANTIES AND OTHER REMEDIES: To the extent
permitted by law, neither Engineering Services nor any company affiliated with it makes any warranties, representations, or promises as to the quality, performance or freedom from defect of the ClearSpanTM frame cover product manufactured by Engineering Services covered by this warranty. IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT APPLICABLE, SHALL BE LIMITED IN DURATION TO THE APPLICABLE PERIOD OF WARRANTY SET FORTH HEREIN. THE PURCHASER’S ONLY REMEDIES IN CONNECTION WITH THE BREACH OR PERFORMANCE OF ANY WARRANTY ON THE CLEARSPANTM PRODUCTS MANUFACTURED BY ENGINEERING SERVICES ARE THOSE SET FORTH HEREIN. IN NO EVENT WILL CLEARSPANTM, OR ANY COMPANY AFFILATED WITH ENGINEERING SERVICES, BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. (Note: Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages so the above limitations and exclusions may not apply to you.)
F. DEALER WARRANTY: NO SELLER OF CLEARSPANTM FRAME COVER PRODUCTS, OTHER THAN ENGINEERING SERVICES, AND IT’S AFFILIATED COMPANIES, ARE AUTHORIZED TO MAKE ANY WARRANTY, NOR HAS ANY AUTHORITY TO MAKE ANY REPRESENTATIONS OR PROMISES ON BEHALF OF ENGINEERING SERVICES OR ANY OF ITS AFFILIATED COMPANIES OR TO MODIFY THE TERMS OR LIMITATIONS OF THIS WARRANTY IN ANY WAY. AUTHORIZED CLEARSPANTM DEALERS WILL PROVIDE COMPLETE END USER-USER CONTACT INFORMATION AND INVOICE FOR END-USERS TO SECURE WARRANTY SERVICE
ACCORDING TO PROVISIONS STATED HEREIN.
G. FAILURE DUE TO IMPROPER INSTALLATION IS NOT COVERED UNDER THIS WARRANTY.
